How to enter
1. Buy any 3 products from the following brands listed below in one transaction from a Franklins store between 01.09.2008 and 28.09.2008. Products included in this promotion are: SunSilk, Lux, Dove, Omo, Jif, Continental, Streets, Lipton, Rexona, Impulse, Lynx, Domestos, Bertolli, Raguletto, Surf, Bushells, Vaseline & Flora.
2. Complete your details on the entry form located in-store, including the 3 barcodes and the number of your Franklins store receipt and either:
a) mail it in a stamped envelope to ‘Franklins Win a Nintendo Wii Promotion 2008, PO Box 686, Eastern Suburbs MC, NSW 2004, or
b) place it in the entry box located in-store.
As part of these terms and conditions you are required to keep the original or a copy of your store receipt(s) for all entries made for a drawn entry to be valid. If for example you enter 10 times, and one of those entries is drawn as a winner, you may be required to provide receipts for all 10 entries. Failure to provide these to the Promoter upon request may, at the Promoter's discretion, result in an invalid entry (and, at the Promoter's discretion, in all of the entrant's entries being invalid).
3. Once your entry has been received it will go into the draw for your chance to win 1 (one) Nintendo Wii console. There is one Nintendo Wii Console to be won per store x 80 stores. Franklins Tamworth and Franklins Meadowbank stores are not included in the promotion and purchases made from these stores will not be considered in the prize draw.
Entries must be received when store closes on 28.09.2008 or with last mail received on 01.10.2008.
Conditions of entry
1. Information on how to enter and prizes form part of these Conditions of Entry. Participating
in this promotion is deemed acceptance of these Conditions of Entry.
2. Entry is only open to residents of N.S.W. and A.C.T. aged 18 years and over. Employees of
the Promoter, Franklins stores and their agencies associated with this promotion and the immediate family of these people are ineligible to enter or win.
3. The Promoter reserves the right, at any time during or after the closing date of the promotion, to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Multiple entries are permitted, subject to the following: (a) only one entry permitted per specified purchase requirement [refer to ‘How To Enter’ section, clause 1.]; and (b) each entry must be submitted separately and in accordance with the entry requirements; (c) each entry must be associated with a separate purchase of 3 products from the Product Brands (as listed in clause 1 of the ‘How To Enter’ section) in a single transaction from a Franklins store (d) proof of purchase for each entry is retained .
5. Entrants must retain a copy of the store receipt/s for all mail entries as proof of purchase. Failure to produce proof of purchase for all mail entries when requested may, in the absolute discretion of the Promoter, result in invalidation of all of an entrant’s entries, forfeiture of any right to a prize and disqualification of the entrant from the promotion.
6. The Promoter is not responsible for receipt of incomplete, damaged or incomprehensible entries. All such entries will be deemed invalid. No responsibility accepted for late, lost or misdirected entries. Any entry that does not comply with these terms and conditions will be invalid.
7. Promotion commences 01.09.2008 and promotion ends 28.09.2008 (“Promotional Period”). Last mail received on 01.10.2008. All draws will take place at Greeneagle Distribution & Fulfilment, Unit 10, 20 Ricketty Street, Mascot NSW 2020 at 4pm AEST on 20.10.08. Judges' decision is final and no correspondence will be entered into.
8. The first valid entry drawn from all entries received in each store will each win a Nintendo Wii Console valued at RRP$399.
9. The winners of the Nintendo Wii consoles will be contacted by phone and mail and the winner’s names will be published in The Sydney Morning Herald on 25.10.2008.
10. Total prize pool for the promotion is valued at $31,920. The Promoter accepts no responsibility for any variation in the prize value. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
11. All prize values are in Australian dollars and include GST.
12. In the event that the prize is not available despite the Promoter’s reasonable endeavours to provide the prize, the Promoter reserves the right to substitute prize(s) to the same and equal recommended retail value and/or specification, subject to any written directions from the various Lottery Departments.
13. The Promoters may conduct such further draws at the same time and place as the original draw as are necessary on 21.01.09 in order to distribute any prizes unclaimed by that date.
14. The Promoter reserves the right to request winners to provide proof of identity, age and residency at the nominated prize collection address as per the details entered on the entry form. Any contact details entered incorrectly shall invalidate the entry at the discretion of the Promoter. Identification considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry, which is not in accordance with these Conditions of Entry and the prize will be redrawn in accordance with these Terms and Conditions. Unrecognised barcodes will not be accepted, nor will photocopy of receipts when originals have been requested.
15. The Promoter reserve the right in their sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the NSW and ACT Lottery Department, to cancel, terminate, modify or suspend the competition, if for any reason this competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition.
16. To the full extent permitted by law, the Promoter and Franklins exclude all liability however so arising (including all liability arising from negligence on the part of the Promoter or Franklins or their officers, employees or agents) for any loss, damage, personal injury or death whether direct, indirect, special or consequential which is suffered or sustained, by the entrants, arising in any way out of or in connection with the promotion, including but not limited to, accepting or using a prize.
17. Winners consent to the Promoter using the winner's name, likeness, image and/or voice, in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
18. The Promoter accepts no responsibility for any taxation consequences. Where the operation of the competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
19. All entries remain the property of the Promoter. The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. If entrants indicate their consent at the point of entry, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. Entrants’ personal information may be disclosed to State lottery department and winners’ names published as required under the relevant lottery legislation.
