How to enter
To enter simply purchase any Lynx product from participating Woolworths and Safeway stores excluding Woolworths and Safeway Home Shop and Caltex Woolworths or Caltex Safeway co-branded outlets between 01/09/08 and 28/09/08 and enter in one of two ways:
(a) By Internet: Log on to www.lynxeffect.com.au/woolworths and follow the prompts to leave your first & last name, postal address, contact details, the last 5 digits of the product barcode found on the reverse of the Lynx product as well as the Woolworths or Safeway receipt number during the Promotional Period;
OR
(b) By SMS: SMS the last 5 digits of the product barcode, your first and last name, age and your Woolworths or Safeway receipt number and postcode (in that order) to 19922777 during the Promotional Period. Entrants must SMS their actual postcode of residence in order for the entry to be valid. SMS cost is $0.55. Entrants must have premium service access. Service Provider is: 5th Finger Pty Ltd.
Retain a photocopy of all Woolworths or Safeway purchase receipts for all entries as proof of purchase. Promoter reserves the right to request proof of purchase for each entry made to verify all entries before awarding the prize. Consumers may enter as many times as they like provided each entry is associated with a separate purchase of a Lynx product.
Terms & conditions
1. Information on how to enter and prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents. Employees of the Promoter, participating Woolworths & Safeway stores, the Promoter’s associated companies, the Promoter’s agencies associated with this promotion and their immediate families are ineligible to enter. Entrants under the age of 18 years must obtain the consent of their parent or legal guardian to enter.
3. Promotion commences at 9.00am on Monday 1st September and entries close at 5.00pm on Sunday 28th September (“Promotional Period”). Online and SMS entries received each day during the Promotional Period will be included in the draw for that day to be drawn the following day. All valid non-winning entries in each draw will roll over into any subsequent draws.
4. Daily Prize Draws will be conducted from Monday to Friday at 17.00 EST starting on the 02/09/08 with last draw happening on the 29/09/08. Weekend draws will take place at the normal draw time on each Monday of the Promotional Period. Entries received on a Saturday or a Sunday will be placed in the draw on the following Monday at 5th Finger, Level 7, Tower Building, Australia Square, 264 George Street, Sydney, NSW 2000.
5. The first valid entry drawn for each daily prize draw will win a LG KU990 mobile phone valued at $899. Total number of daily prizes in prize pool is 28.
6. Instant Win Prizes: There are 50 random instant win prizes of 50 x Guitar Hero 3 games. Winners can choose between the PS3 format or the X360 format, each valued at $169.00 OR the Wii format valued at $159.00. Each instant win prize will be awarded randomly to entrants who enter via the Internet or SMS. There will be 25 x Internet winners and 25 x SMS winners.
7. The Promoter’s decision is final and no correspondence will be entered into. The Prize winner’s will be contacted by phone and mail within seven days of the relevant Daily Prize Draw date. The name of the winners of the Daily Prize Draw and the Instant Win prizes will be published in The Australian on 22/10/2008.
8. Total prize pool is valued at up to $33,622.
9. Prize will only be delivered in Australia by courier and winner/s should allow 28 days for delivery of their prize.
10. The Promoter reserves the right to verify the validity of entries, at any time during or after the promotion, and reserves the right to disqualify any entrant (and ALL entries submitted by that entrant) for tampering with the entry process, including but not limited to the use of techniques designed to avoid payment of call costs, for submitting an entry which is not in accordance with these Terms and Conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. Entrants are limited to one entry per product purchased. Proof of purchase for every entry submitted, in the form of a photocopy of an original store purchase receipt(s), must be provided on the Promoter’s request in order to claim the prize. Where a copy of the receipt is not provided on request, or the receipt/s records a purchase outside of the promotional period, the entry will be deemed invalid and the prize will be re-drawn in accordance with these Terms and Conditions.
12. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted from that source and by those entrants invalid.
13. Cost of accessing the Internet is the entrant’s responsibility. Any costs associated with accessing the promotional website are the entrant’s responsibility and are dependent on the internet service provider used. Any contact details entered incorrectly shall invalidate the entry. The Promoter is not responsible for receipt of incomplete or incomprehensible entries. All such inaccurate entries will be deemed invalid. No responsibility is accepted for late, lost or misdirected entries. Any entry that does not comply with these Terms and Conditions will be invalid.
14. The person whose mobile service is used to send the SMS message is deemed the Entrant. Entrants who use another person’s phone may be disqualified. The maximum cost of an SMS will not exceed 55 cents (including GST). SMS entries via the internet are not valid and will not be accepted. The SMS entry mechanic is only open to consumers with an SMS compatible mobile phone connected to a service provider, which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service providers in this regard. SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so their prize may be awarded. SMS entries via internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant. Service Provider is 5th Finger.
15. The Promoter may conduct an unclaimed prize draw if necessary at the same time and place as the original draw on 29/12/2008 in order to distribute any prize/s unclaimed by that date, subject however to any directions from a regulatory authority. Any winners in the unclaimed prize draw of prizes valued at over $100 will have their name and postcode published in The Australian on 30/12/2008.
16. The Promoter accepts no responsibility for any tax implications that may arise from acceptance of the prize winnings. Independent financial advice should be sought.
17. Limit of one prize per household per day, except in the case of winners from SA and ACT
18. A prize, or any unused portion of a prize which is not used within the specified period, is not transferable or exchangeable and cannot be taken as cash unless specified otherwise.
19. In the event that a prize is not available despite the Promoter’s reasonable endeavours to procure the prize, the Promoter reserves the right to substitute a prize of equal recommended retail value, subject to any written directions from a relevant Regulatory Authority.
20. The Promoter accepts no responsibility for any variation in the prize value.
21. The Promoter is not liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with taking the prize, except for any liability which cannot be excluded by law.
22. It is a condition of entry that the winner (and companion) may be required to execute a Deed of Acknowledgement, Release and Indemnity in a form prescribed by the Promoter in its discretion.
23. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion subject to any written directions from a relevant Regulatory Authority.
24. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the telephone or internet user or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to participants or any other person’s computer related to or resulting from participating in or downloading any materials in the promotion. If for any reason this promotion is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by a relevant Regulatory Authority, to cancel, terminate, modify or suspend the promotion.
25. All entries become the property of the Promoter. The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering this promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at its address set out below. 26. Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
27. The Promoter reserves the right to request winners to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
