Streets win lunch time fun promotion

Terms & conditions

1. Information on how to enter and prizes form part of these Terms and Conditions. 

2. There will be a total of 425,000 game cards distributed to schools canteens Throughout Australia excepting Victoria The first 850 schools who purchase a 20 carton “Back to School” order or any new school customers who purchase a 10 or 20 carton order (“Participating Canteen”) will each receive a Schools Incentive Drive Kit.

3. Each kit contains 500 game cards to be given away with the first 500 Streets amber products sold during the Promotional Period, along with the corresponding prizes.

4. Entry is open to all residents of Australia excepting Victoria who fulfil the eligibility and entry requirements.  The directors, management and employees, and their immediate families, of the Promoter, Beinteractive Pty Ltd, their related companies, agencies, suppliers and participating stores are ineligible to enter.

5. Promotion commences 01/01/2010 and ends at 17:50 (local time) on 01/05/2010 or when all game cards have been distributed and all prizes won, whichever is the first to occur. (“Promotional Period”). All Instant Win prize claims must be redeemed at the Participating Canteen in which the winning product was purchased and game card issued by 5:00pm (local time) on 01/08/2010. Any prizes not redeemed by this time must be returned to the Promoter.

6. To enter, consumers must purchase any Amber Streets product from a Participating Canteen during the Promotional Period to receive a game card, open the panel to reveal whether you are an instant winner.

7. Each game card will contain one of the following messages:

(i) “You’ve Won a Streets Paddle Pop Soccer Ball!” or
(ii) “You’ve Won a Streets Paddle Pop Tennis Ball!”; or
(iii) “You’ve Won a Streets Paddle Pop Rugby Ball!”; or
(iv)  “Sorry, Better Luck Next Time

How to claim a prize:

8. Instant Win prizes must be redeemed at the Participating Canteen the winning product was purchased and game card issued from, by 5pm (local time) on 01/08/2010.

9. Any unclaimed prizes will be donated to the school, subject however to the directions of relevant state legislation.

10. The Promoter reserves the right, at any time, to verify the validity of prize claims/second chance draw entries and claimants/entrants (including a claimant’s/entrant’s identity, age and place of residence) and to disqualify any claimant/entrant who tampers with the claims/entry process or who submits a claim/entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

11. No responsibility is accepted for late, lost, delayed or misdirected prize claims/second chance prize draw entries.  Incomplete or incomprehensible claims/entries will be ineligible.

Instant Win & Collectable Prizes:

12. The following prizes will be available to be won instantly via instant win game cards:

(i) 4250 Streets Paddle Pop Moo Soccer Balls  valued at AU$10 incl GST each;
(ii) 4250 x Paddle Pop Rugby Ball valued at AU$10 incl GST each; and
(iii) 8500 x Streets Paddle Pop Tennis Balls valued at $5 incl GST each.

13. Total value of the prize pool is valued at up to AU$127,500 (incl GST). No responsibility is accepted for any variations in the value of any prize. Prizes or any unused portion of a prize are not transferable or exchangeable and cannot be taken as cash.

14. The Promoter recommends that safety gear be worn at all times when using the prizes. Unless specifically stated, all safety gear, safety helmet, and any additions, modifications or accessories, or any other ancillary costs not specifically included in the prize are the sole responsibility of the winners.

15. In the event that a prize is not available, the Promoter reserves the right to substitute prize in its discretion to the same and equal recommended retail value and/or specification subject to any written directions from the various lottery Departments.  In the event that the original product model to be awarded is still available but a newer product model also becomes available at the time of awarding the prize, the Promoter reserves the right, in its absolute discretion, to negotiate with the winner(s) to award the most current model product of similar description to the same or equal recommended retail value at time of awarding the prize, if the winner agrees.

General conditions:

16. All entries remain the property of the Promoter.

17. Game Cards will be void if stolen, forged, mutilated or tampered with in any way. Winning game cards will be checked for validity and authenticity upon receipt by the Participating Canteen prior to awarding the prize.

18. There will be a total of 425,000 game cards printed for this promotion.Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these terms and conditions, all prize claims in excess of the advertised prize pool will be honoured.

19. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

20. If for any reason this promotion is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right in its sole discretion to cancel, postpone or amend the promotion, subject to direction of state legislation.

21. Prizes can not be transferred or redeemed for cash.

22. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

23. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

24. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

25. The Promoter reserves the right to request winners to provide proof of age, identity and residency at the nominated prize delivery address.  Identification considered suitable for verification is at the discretion of the Promoter.

26. The Promoter reserves the right to conduct security verification checks at its absolute discretion.  Prize winners may be required to sign a declaration confirming their eligibility to accept the prize.

27. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.

28. The Promoter shall not be held liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury suffered or sustained, as a result of participating in the promotion or accepting a prize, except for any liability which cannot be excluded by law.  The Promoter will not be responsible for any incorrect, inaccurate, incomplete information communicated in the course of or in connection with this promotion, including without limitation technical malfunctions or failures.

29. The Promoter collects claimants’/entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the claimant/entrant may not be able to participate in the promotion. The Promoter will not disclose this information to anyone other than contractors who provide services to the Promoter for the purposes of conducting this promotion unless compelled or permitted by law. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. As per the relevant Privacy Legislation, a request to access, update or correct any information should be directed to the Privacy Officer of the Promoter at its address below.
