How to enter

1. To be eligible to enter, individuals must purchase any Streets Magnum pack (includes individual and grocery multi-packs) between 9am (NZST) on 15.06.09 and 11.59pm (NZDST) on 10.10.09 (“Promotion Period”). Entry into this promotion is not valid in conjunction with any other promotion or offer.

2. To enter entrants must send a text message to 3002 containing the last 4 digits of the product barcode from the individual Streets ice cream or multi-pack purchased along with their full name, suburb and postcode (in that order) during the Promotion Period for a chance to win.

3. All messages to 3002 will be at the standard text message charge $0.20 made by the sender's provider.

4. All entries received by text will receive a free confirmation text by return to confirm the entry has been received.

5. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

6. Entry is only open to New Zealand residents. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

8. Incomplete or indecipherable entries will be deemed invalid.

9. Entrants must retain either their original receipt or the original barcode from the Streets Magnum wrapper or multi-pack used to enter the promotion as proof of purchase for each entry.  One receipt/barcode entitles the entrant to one entry.  Failure to produce the proof of purchase or barcode for ALL entries made by that entrant when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. The purchase receipt(s) provided must clearly specify that the purchase was made during the Promotional Period.

10. Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will void all entries by that entrant. Text message entries via the internet are ineligible and will render all entries submitted by that entrant invalid.

11. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; (c) unrecognised barcodes will be deemed invalid and (d) a maximum of four (4) entries per household per day is permitted.

12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

13. The promotion commences on 15.06.09 at 9am NZST and closes on 10.10.09 at 11.59pm NZDST (“Promotion Period”). There are 3 major prizes to be won and the major prize draw closes on 10.10.09 at 11.59pm NZDST.  Prize draws will take place on the dates specified below. All draws will take place at The Hyperfactory, 2 Vernon Street, Freemans Bay, Auckland on 12.10.09 at 9:00am NZDST. All winners will be notified by text message and published in The New Zealand Herald on 27.10.09. The Promoter’s decision is final and no correspondence will be entered into.

14. As part of the conditions of entry all winners will be required to sign acceptance of these terms and condition.

15. The mobile phone number from which the entrant sends the text message entry must be owned by the entrant. The Promoter may require a winner to validate their entry by showing that they are the account holder of the mobile telephone number and proof of residence as per their entry details. The only acceptable proof that a winner is the account holder of the mobile telephone number will be an original invoice in the name of the entrant or an original letter on the service provider’s letterhead confirming the entrant’s ownership. If an entrant is unable to provide proof that they are the account holder of the mobile telephone number within 14 days of request by the Promoter then the Promoter may in its discretion treat the entry as void and the Prize will be treated as an unclaimed Prize.

16. All entrants must ensure that their entries are received by the Promoter before the end of the Promotion Period. The Promoter takes no responsibility for late, lost or misdirected entries or for any delays or failures in any telecommunications service or equipment. Entries are deemed to be received at the time of the receipt into the Promotion database and NOT at the time of transmission by the entrant.

17. Each prize consists of return economy airfares for 2 people to Melbourne from either Auckland, Wellington or Christchurch.  Tickets must be used by the prize winner and cannot be transferred to another person.  Prize includes transfers from Melbourne Airport to accommodation, 2 nights accommodation in a 5 star hotel including breakfast for two (2); limousine transfers from the hotel to the Gold Class Cinemas, 2 Gold Class movie tickets and $250.00AU spending money. Additional spending money, meals, transport to and from departure points in New Zealand and Australia, additional transfers (if required), items of a personal nature, in-room charges, insurance and all other ancillary costs are not included In the prize.  A valid passport will be required for travel to the prize destination.  A valid credit card will be required when checking in to prize accommodation.  Compliance with any health or government requirements is the responsibility of the prize winner and their travel companion.  It is the responsibility of the prize winner to enquire about local issues and conditions at destinations prior to travel.  International travel advice can be obtained from various sources, including local government, local consular offices and the website of the New Zealand Ministry of Foreign Affairs and Trade.  The Prize may not be taken during peak periods or on public holidays. The prize must be redeemed by 30.06.10. The total recommended retail value of each prize is up to $6,582.55NZD.

18. It is the winner’s own responsibility to arrange transportation between their own residence and the airport. Should the winner miss their scheduled flight for any reason whatsoever, replacement tickets will not be issued by the Promoter. Any additional elements of the trip that are affected will also not be rescheduled or replaced.

19. Prizes are subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.

20. Redemption of the Gold Class movie tickets are subject to any terms and conditions of the issuer including those specified on the Gold Class movie tickets. The Gold Class movie ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organizers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

21. If the winner of a prize is under the age of 18 years, the winner acknowledges that they have the permission of their parent/guardian to enter the Promotion and that the prize will be awarded to the winner's nominated parent or guardian.

22. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

23. Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.

24. Total prize pool value is $19,747.65NZD. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

25. The Promoter shall conduct further draws to award any unclaimed prizes as may be deemed necessary at Hyperfactory at 2 Vernon Street, Freemans Bay, Auckland on 18.01.10 at 10am NZDST.  In the event that any of the major prizes are awarded in the unclaimed prize draw, the names of the winner(s) will be published in The New Zealand Herald on 01.03.10.

26. Any costs associated with accessing the promotional website, www.streetsicecream.co.nz, is the entrant’s responsibility and is dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

27. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

28. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

29. Except for any liability which cannot be excluded by law the Promoter: Is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on any computer system or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person’s property related to or resulting from participation in this Promotion; accepts no responsibility for any incorrect or inaccurate information, either caused by users or by any of the equipment or programming associated with or utilised in connection with this Promotion, or by any technical error that may occur in the course of this Promotion, including (but not limited to) any failure of the computer system or other equipment to determine winners in accordance with these Conditions of Entry; and accepts no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access.

30. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

31. Nothing in condition 29 or condition 30, is intended to exclude, restrict or modify the entrant's rights under the Consumer Guarantees Act 1993.

32. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to agents, contractors, prize suppliers and as required, to Australian or New Zealand regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes including telephoning the entrant or sending electronic messages to entrants who have "opted in" to receive those electronic messages. Entrants should direct any request to access, update or correct information to the Promoter at the address below. All entries become the property of the Promoter.
