Terms & conditions
1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
2. Entry is open to all residents of Australia. However, employees and their immediate families of Unilever Australia Ltd, Beinteractive Pty Ltd & participating stores and their associated agencies and companies are not eligible to enter.
3. The competition commences on Tuesday 31 March 2009 at 00.01 AEDT and concludes on Tuesday 7th July 2009 at 23.59 AEDT (“Promotion Period”).
To enter, participants must send a SMS message to 199 99 772 and register their details including (but not limited to) the last 6 (six) digits of their valid Streets Cornetto, Gaytime, or Cookie product barcode, full name, address and postcode (e.g. 123456 John Smith 1 George St Sydney NSW 2000) purchased from participating stores during the Promotion Period. Entrants will receive a reply message as confirmation of their entry. The person whose mobile service is used to send the SMS message is deemed the Entrant. Entrants who use another person’s phone may be disqualified.
4. 1,000 Instant prize winners will be drawn at random by the Beinteractive Pty Ltd Instant Win system over the promotional period. Winners will be notified by SMS that they are an instant winner and what prize they have won. Instant winners will be issued a 6 digit unique Prize Claim Number as generated by the Beinteractive Pty Ltd Instant Win system. The unique 6 digit Prize Claim Number (‘PCN’) will need to be retained by the Instant Winner for prize verification purposes. In the event of any dispute with the Promoter, or at the Prompter’s request, Instant Winners will be required to correctly quote their unique Prize Claim Number to be awarded their prize. The Promoter reserves the right to withhold the awarding of an instant prize to a Winner who cannot provide a valid, unique Prize Claim Number. Any unclaimed or un-verified prizes will be awarded during the second chance draw. Entrants who are not instant winners will be notified that they have been automatically entered into the unclaimed prize draw and major prize draw.
5. The variety of DVD’s will include Million Dollar Baby, Music and Lyrics, Chocolat and The Notebook. The DVD’s will be awarded to winners at random over the period.
6. Each DVD has a value of $10 (including GST) each.
7. In the event that not all DVD’s are given away over the promotional period. A draw will take place from all entrants that were not deemed winners by the Beinteractive Pty Ltd instant win system, and remaining DVD’s will be awarded. The draw will take place at the same place and time as the major prize draw outlined in condition 40.
8. The total value of instant win prizes is $10,000 AUD (inc GST)
9. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.
10. Incomprehensible and illegible entries will be deemed invalid.
11. Entrants may enter up to twice per day during the Promotional Period, provided each entry relates to a separate purchase of a Streets Cornetto, Gaytime or Cookie product during the Promotion Period.
12. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or PCN) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
13. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
14. Entries must be received by 23.59 (AEDST) on Tuesday 7th July 2009. The time of entry will in each case be the time the SMS message is received by the Beinteractive Pty Ltd database and not the time of transmission by the entrant. The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
15. Maximum entry cost is $0.55 (including GST). Service not available from payphones.
16. In addition to the 1,000 instant prizes, there are 2 (two) major prizes to be won. This Prize is available for a family of 2 (two) Adults and 2 (two) Children aged between 3 and 13 years. The prize includes :

17. Each Major prize is valued at a total of up to $5,973 (including GST)
18. Total prize major prize value is up to $11,946 (including GST)
19. The total prize pool for the promotion is $ 21,946 (including GST)
20. Prizes cannot be transferred or redeemed for cash.
21. The winners of the major prize will need to comply with the following terms in participating in the Sea World Tropical Reef Snorkel:
* Participants must be 10 years of age or over.
* Participants must read and acknowledge all health risks (some medical conditions will prohibit participation).
* Participants must be competent swimmers/able to swim unaided.
* Participants must have controlled motor movement.
* Participants must be able to understand and follow directional hand signals of staff as outlined in snorkel briefing.
* Participants must be able to quickly exit the pool area unassisted.
* Participants must not have any open cuts or infections.
* Guests with disabilities are asked to call Customer Connect on 13 33 86 to determine suitability to participate in the Animal Adventures programs. Please note a limited number of special needs programs are available for people with disabilities that otherwise prohibit them from participating.
22. The winner and their companions are responsible for all other expenses including additional spending money, meals (unless specified), drinks, laundry charges, activities (other then those specified), incidentals, taxes (excluding departure taxes), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
23. The winner and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Adelaide or Perth). (If the winner is from Tasmania, ACT or NT connecting flights from these cities to the nearest flight departure capital city will be included in the prize package for the winner and travelling companion only – if applicable). If the winner resides in QLD appropriate transport and transfers will be provided for the winner and their travelling companion.
24. The family holiday prizes must be redeemed/taken by 6th December 2009 and is subject to hotel and flight availability. Bookings must be made at least 30 prior to travel date. Available time periods exclude Queensland School holiday periods and Indy week. Arrangements for travel cannot be changed once the booking has been made.
25. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
26. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
27. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers.
28. Unilever Australia Ltd, Beinteractive Pty Ltd and participating stores make no representation as to the safety, conditions or other issues that may exist at any destination included in the prize. Travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.
29. By entering this competition, entrants and their companions accept and acknowledge full responsibility for their decision to participate in the fun parks specified in condition 13 of these terms and conditions should they be chosen as a winner. The winner releases the Promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties will not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the fun parks specified in condition 13 of these terms and conditions or any other aspect of the prize. The winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize. It is a condition if entry that the winner (and companions) may be required to execute a Deed of Acknowledgement, Release and Indemnity in a form prescribed by the Promoter in their discretion.
30. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
31. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
32. Once the instant prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
33. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
34. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
35. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the media or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
36. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
37. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
38. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
39. If the competition winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian.
40. Each valid entrant who has submitted a valid entry during the Promotional Period will be entered into the major draw. 2 valid entrants will be drawn at random to become the major winners. The draw will take place at Beinteractive Pty Ltd, Level 9, 155 George Street, Sydney NSW 2000, on Wednesday 15 July 2009 at 11:00 (AEDST).
41. The winners will be notified by telephone on the mobile number used to enter within 2 days of the draw and will also be sent a letter advising them of their prize. Winners of prizes valued over $250 will be published in the Public Notices section of The Australian newspaper on Tuesday 21 July 2009.
42. Prizes will only be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder). The winner will therefore be, in each case, the account holder.
43. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
44. Subject to relevant state regulation, an unclaimed prize draw will take place at Beinteractive Pty Ltd, Level 9, 155 George Street, Sydney NSW 2000 on Tuesday 27 October 2009 at 10:00 (AEDST) and winners of prizes valued over $250 will have their details published in the Public Notices section of the Australian on Wednesday 4 November 2009.
45. The Promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
46. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
47. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
48. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
49. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
50. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
51. Unilever Australia Ltd & Beinteractive Pty Ltd, participating stores and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
52. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
53. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
54. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.
55. Beinteractive Pty Ltd, on behalf of Unilever Australia Ltd is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Beinteractive Pty Ltd for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.
56. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
